LIFTCONDUCTOR TERMS OF USE

1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of websites, content, software, platforms, features, and services provided by Lift Conductor LLC ("LiftConductor," "we," "our," or "us"), including the LiftConductor platform and LiftWorkshop (collectively, the "Services").
By accessing or using the Services, you agree to these Terms.
If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Certain customers may enter into a separate subscription agreement, services agreement, order form, statement of work, data processing agreement, or other written agreement with LiftConductor. If a separate written agreement conflicts with these Terms, the separate agreement will control to the extent of the conflict.
2. The LiftConductor Platform
LiftConductor is a decision-support and business experimentation platform designed to help organizations structure experiments, develop test and control groups, evaluate causal effects, document evidence, and preserve organizational learning.
The platform is intended to support disciplined analysis and decision-making.
It does not make business decisions on behalf of users and does not eliminate the need for professional judgment.
Analytical results depend upon factors including the quality and completeness of underlying data, research design, assumptions, methodology, implementation, external conditions, and interpretation.
Users remain responsible for evaluating results and for decisions or actions taken based upon information produced through the Services.
3. LiftWorkshop
LiftWorkshop is an educational and editorial resource focused on experimentation, evidence, causal inference, decision-making, decision integrity, and related topics.
LiftWorkshop content is provided for general informational and educational purposes.
It may include articles, essays, reflections, examples, illustrations, frameworks, analytical methods, commentary, opinions, and other materials.
LiftWorkshop content does not constitute legal, accounting, tax, investment, financial, or other regulated professional advice.
Examples and illustrations may simplify real-world circumstances to explain concepts and should not be assumed to apply to every organization or situation.
Users remain responsible for determining whether information presented through LiftWorkshop is appropriate for their particular circumstances.
4. User Responsibilities
You agree to use the Services only for lawful purposes and in accordance with these Terms.
You agree not to:
attempt to gain unauthorized access to the Services, accounts, systems, or networks;
interfere with or disrupt operation or security of the Services;
circumvent access, security, usage, or technical restrictions;
introduce malicious software or harmful code;
use automated systems in a manner that materially interferes with the Services;
manipulate likes, reactions, engagement counts, or other interactive features;
reverse engineer, decompile, or attempt to derive source code except where expressly permitted by applicable law;
use the Services to violate applicable law or third-party rights; or
falsely represent your identity, affiliation, or authority.
Users with accounts are responsible for maintaining the confidentiality and security of their credentials and for activity conducted through their accounts.
5. Customer Data
Customers retain ownership of information, data, documents, and materials they submit to the LiftConductor platform ("Customer Data").
Customers grant Lift Conductor LLC a limited, non-exclusive license to host, store, reproduce, process, transmit, and otherwise use Customer Data only as reasonably necessary to provide, maintain, secure, and support the Services and fulfill our contractual obligations.
Customers represent that they have the rights and authority necessary to provide Customer Data to LiftConductor for these purposes.
LiftConductor does not acquire ownership of Customer Data.
LiftConductor will not sell Customer Data or use proprietary Customer Data to compete with customers.
LiftConductor may use aggregated, anonymized, or de-identified information to evaluate and improve its products, services, methods, and operations, provided that such information does not reasonably identify a customer, individual, or proprietary customer information.
6. Intellectual Property
The Services and their underlying intellectual property – including software, source code, workflows, methodologies, designs, documentation, trademarks, graphics, interfaces, frameworks, and related materials – are owned by Bendle Companies LLC or applicable licensors and are licensed to Lift Conductor LLC for commercial operation.
LiftWorkshop content, including original articles, essays, reflections, graphics, frameworks, illustrations, and other original materials, is protected by applicable intellectual property laws.
Except as expressly permitted in these Terms, no intellectual property rights are transferred to users.
7. Sharing and Use of LiftWorkshop Content
We encourage readers to discuss and share LiftWorkshop ideas.
You may:
link to LiftWorkshop content;
share links through email, social media, or other communications;
quote reasonable excerpts for commentary, discussion, criticism, education, or other uses permitted by applicable law; and
identify LiftWorkshop or LiftConductor as the source of shared material.
You may not, without permission:
reproduce or republish substantial portions of LiftWorkshop content as your own;
systematically copy or redistribute LiftWorkshop materials;
remove copyright, trademark, attribution, or proprietary notices;
sell or commercially redistribute LiftWorkshop content; or
represent LiftWorkshop or LiftConductor content as your own work.
Nothing in these Terms limits rights available under applicable copyright law, including fair use.
8. Reflections, Comments, and Other Submissions
LiftWorkshop may invite readers to submit comments, questions, ideas, feedback, or reflections ("Submissions").
You retain ownership of original material contained in your Submissions.
By sending a Submission to us, you grant LiftConductor permission to receive, store, review, and use the Submission as reasonably necessary to respond to you, understand audience interests, improve LiftWorkshop, and develop ideas or future content.
Submitting an idea does not give you ownership of independently developed LiftConductor or LiftWorkshop content, concepts, products, or services that may be similar to your Submission.
We will not publicly attribute a private Submission to you or publish it as your statement without appropriate permission.
If we wish to quote, publish, or identify you in connection with a private Submission, we will seek your permission before doing so.
Please do not submit information that you do not have the right to disclose.
9. Likes, Reactions, Sharing, and Interactive Features
LiftWorkshop or other portions of the Services may provide likes, reactions, sharing tools, or similar interactive functionality.
These features are intended to facilitate genuine engagement with content.
We may use reasonable technical measures to prevent automated activity, duplicate reactions, manipulation, abuse, or other activity that could undermine the integrity of these features.
We may remove, disregard, aggregate, or adjust activity that we reasonably believe is automated, fraudulent, abusive, or otherwise inconsistent with the intended operation of a feature.
Use of these features is also subject to our Privacy Policy.
10. Email Communications
Users may voluntarily subscribe to communications from LiftWorkshop or LiftConductor.
By subscribing, you agree to receive communications consistent with the notice presented when you subscribe.
Marketing communications will provide a mechanism to unsubscribe or manage applicable communication preferences.
Unsubscribing from marketing communications does not necessarily prevent us from sending transactional, administrative, security, or service-related communications that are reasonably necessary in connection with an existing business relationship or use of the Services.
11. Privacy
Our collection and use of personal information is described in the LiftConductor Privacy Policy.
By using the Services, you acknowledge that information may be processed as described in that Policy.
12. Confidentiality
The LiftConductor platform may contain non-public proprietary methodologies, workflows, software, documentation, business processes, and other confidential information.
Customers and authorized users agree not to disclose or misuse such confidential information except as permitted in connection with authorized use of the Services or under an applicable written agreement.
Customer confidentiality obligations applicable to LiftConductor may also be governed by separate customer agreements, nondisclosure agreements, or other written agreements.
13. Third-Party Services and Links
The Services may integrate with, rely upon, or link to third-party products, websites, platforms, or services.
Use of third-party services may be subject to separate terms and privacy policies established by those providers.
LiftConductor does not control and is not responsible for the availability, security, content, functionality, or practices of unaffiliated third-party services.
14. Service Availability and Changes
We strive to provide reliable Services but do not guarantee uninterrupted or error-free availability.
We may modify, update, improve, suspend, restrict, or discontinue portions of the Services from time to time.
Commercial customers may have additional service availability or support rights under separate written agreements.
15. Disclaimers
THE SERVICES AND LIFTWORKSHOP CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFT CONDUCTOR LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF RESULTS.
LIFTCONDUCTOR DOES NOT WARRANT THAT ANALYSES, ESTIMATES, STATISTICAL RESULTS, RECOMMENDATIONS, EDUCATIONAL MATERIALS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICES WILL BE ERROR-FREE OR APPROPRIATE FOR ANY PARTICULAR DECISION OR PURPOSE.
Business and analytical outcomes depend upon numerous factors outside LiftConductor's control.
LiftConductor therefore does not guarantee any particular decision, causal conclusion, recommendation, business outcome, financial result, operational improvement, or other result from use of the Services.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LIFT CONDUCTOR LLC AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF BUSINESS OPPORTUNITY, BUSINESS INTERRUPTION, OR LOSS OF DATA ARISING FROM OR RELATING TO THE SERVICES.
For customers who have paid LiftConductor for Services, Lift Conductor LLC's aggregate liability arising out of or relating to the Services will not exceed the fees paid or payable by the customer to LiftConductor during the twelve (12) months immediately preceding the event giving rise to the claim, unless a separate written agreement provides otherwise.
For users of free website content or Services who have paid no fees to LiftConductor, Lift Conductor LLC's aggregate liability will not exceed $100, to the fullest extent permitted by applicable law.
Some jurisdictions do not permit certain exclusions or limitations of liability, so portions of this Section may not apply to you.
17. Suspension and Termination
We may suspend, restrict, or terminate access to the Services when reasonably necessary to:
address a violation of these Terms;
protect the security or integrity of the Services;
prevent fraud, misuse, or unlawful activity;
comply with legal requirements; or
protect LiftConductor, our customers, users, or others.
Commercial customers may terminate or discontinue Services subject to applicable subscription agreements, order forms, or other written agreements.
18. Changes to These Terms
We may update these Terms periodically to reflect changes in our Services, business practices, or legal requirements.
When we update these Terms, we will revise the "Last Updated" date.
If changes materially affect users' rights or obligations, we may provide additional notice when appropriate or required by law.
Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Kansas, without regard to conflict-of-law principles.
20. General Terms
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.
Failure by LiftConductor to enforce a provision of these Terms does not constitute a waiver of that provision.
You may not assign your rights or obligations under these Terms without our prior written consent. LiftConductor may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or similar transaction.
These Terms, together with the Privacy Policy and any applicable written agreement between you and LiftConductor, constitute the applicable agreement regarding use of the Services.
