LIFTCONDUCTOR TERMS OF USE

1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the LiftConductor platform, website, software, and related services (collectively, the "Service").
The Service is provided by Lift Conductor LLC ("LiftConductor," "we," "our," or "us").
By accessing or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Nature of the Service
LiftConductor is a decision-support platform designed to help organizations create, manage, measure, and preserve disciplined decision processes.
The Service is intended to:
create structure around experimentation and measurement
improve consistency in decision-making
organize and preserve institutional knowledge
support interpretation of analytical results
The Service is not intended to:
replace human judgment
make decisions on behalf of users
guarantee business outcomes
provide legal, accounting, investment, or other professional advice
Users remain solely responsible for all business decisions and actions taken based upon information provided through the Service.
3. User Responsibilities
You agree to:
use the Service only for lawful purposes
provide accurate information
maintain the security of your credentials
comply with applicable laws and regulations
You agree not to:
attempt unauthorized access
interfere with platform operation
reverse engineer or misuse the Service
use the Service to violate applicable laws or third-party rights
4. Customer Data
You retain ownership of all information, data, documents, and materials you upload or submit ("Customer Data").
You grant Lift Conductor LLC a limited, non-exclusive license to host, store, process, display, and transmit Customer Data solely as necessary to operate and improve the Service.
LiftConductor will not sell Customer Data or use it to compete with customers.
Aggregated and anonymized information may be used to improve the platform.
5. Intellectual Property
The LiftConductor platform, including its software, workflows, methodologies, documentation, visual designs, trademarks, and related intellectual property, is owned by Bendle Companies LLC or its licensors and is licensed to Lift Conductor LLC for commercial operation.
Nothing in these Terms transfers ownership of any intellectual property to the user.
6. Confidentiality
The Service contains proprietary methodologies, workflows, software, and business processes.
Users agree not to copy, disclose, or misuse confidential information except as necessary for authorized use of the Service.
7. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted availability.
We may modify, improve, suspend, or discontinue portions of the Service from time to time.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFT CONDUCTOR LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF RESULTS.
Because business outcomes depend upon numerous factors beyond the Service, LiftConductor does not warrant or guarantee any particular decision, recommendation, business outcome, financial result, or operational improvement.
9. Limitation of Liability
To the fullest extent permitted by law, Lift Conductor LLC shall not be liable for:
indirect damages
incidental damages
consequential damages
lost profits
lost revenue
business interruption
loss of data
arising from or relating to the use of the Service.
The total liability of Lift Conductor LLC arising from these Terms shall not exceed the fees paid by the customer for the Service during the twelve (12) months immediately preceding the claim.
10. Third-Party Services
The Service may integrate with or rely upon third-party providers.
LiftConductor is not responsible for third-party products, services, or outages.
11. Suspension and Termination
We may suspend or terminate access for violation of these Terms or to protect the security or integrity of the Service.
Customers may discontinue use at any time subject to any applicable subscription agreement.
12. Changes to These Terms
We may revise these Terms periodically.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed under the laws of the State of Kansas, without regard to conflict-of-law principles.
